Terms & Conditions
These Terms & Conditions ("Terms") are a legally binding agreement between you ("you", "User") and PublicMe ("PublicMe", "we", "us", "our"), governing your access to and use of the website publicme.app and all PublicMe products and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made thereunder. No physical or digital signature is required.
1. Eligibility
- You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
- You must not be barred from using the Service under any applicable law.
- If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Your account
- You are responsible for the accuracy of the information you provide and for all activity under your account.
- Keep your credentials confidential. Notify us immediately of any unauthorised access at support@publicme.app.
- One person or legal entity per account, unless we agree otherwise in writing.
3. The Service
PublicMe currently offers, or will offer:
- Bio Links — a public page aggregating your links and content.
- Social Media Automation — scheduling and cross-posting to platforms you connect (e.g. Instagram, Facebook, X, LinkedIn, YouTube).
- WhatsApp Messaging — sending and receiving messages on the WhatsApp Business Platform using Meta's Cloud API.
We may add, modify, or discontinue features at any time. We will give reasonable notice for material changes affecting paid features.
4. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right (including intellectual property and privacy rights).
- Send spam, unsolicited bulk messages, scams, phishing, or deceptive content.
- Distribute malware, viruses, or any harmful code.
- Harass, threaten, defame, or abuse any person.
- Post or transmit content that is obscene, sexually explicit involving minors, hateful, or that incites violence.
- Reverse-engineer, scrape, or otherwise probe the Service except as expressly permitted by law.
- Resell, sublicense, or commercially exploit the Service without our written consent.
- Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure.
We may suspend or terminate your access for any breach, and we may report serious violations to law enforcement.
5. WhatsApp & Meta platform rules
WhatsApp messaging via PublicMe is provided through Meta's WhatsApp Cloud API. In addition to these Terms, you must comply with:
- Meta's WhatsApp Business Terms of Service
- The WhatsApp Business Messaging Policy (no spam, opt-in required, template messages only outside the 24-hour window, etc.)
- The WhatsApp Commerce Policy
Violations of Meta's policies may result in your WhatsApp Business Account being throttled, disabled, or banned by Meta. We are not responsible for actions taken by Meta. You are solely responsible for obtaining valid opt-in from your recipients.
6. Connected third-party services
When you connect a third-party account (e.g. Instagram, Facebook, X, LinkedIn, YouTube), you authorise us to access and act on that account on your behalf to the extent necessary to deliver the Service. Your use of those services is governed by their own terms. We are not responsible for third-party outages, rate limits, policy changes, or account actions taken by those services.
7. Your content
- Ownership. You retain ownership of all content you upload, post, or send through the Service ("User Content").
- Licence to us. You grant PublicMe a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, modify (e.g. resize), transmit, publish, and display your User Content solely to operate and improve the Service and to publish it to the destinations you choose.
- Responsibility. You represent that you own or have the necessary rights to your User Content, and that it does not violate any law or third-party right.
- Removal. We may remove User Content that violates these Terms or applicable law, with or without notice.
8. Fees, payments, refunds
The Service may include free and paid plans. If you subscribe to a paid plan, you authorise us (and our payment processor) to charge the applicable fees, taxes, and any renewal charges. Unless required by law, fees are non-refundable. We will publish a separate refund and cancellation policy alongside paid plans before billing begins.
9. Intellectual property
The Service, including its design, code, logos, text, graphics, and trademarks (other than User Content and third-party marks), is owned by PublicMe and protected by Indian and international laws. No rights are granted to you except as expressly stated in these Terms. The PublicMe name and logo are our trademarks. You may not use them without our prior written consent.
10. Privacy
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that messages will be delivered without delay.
12. Limitation of liability
To the maximum extent permitted by law, PublicMe and its operator(s) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service.
Our total aggregate liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period, or (b) INR 5,000.
13. Indemnity
You agree to indemnify and hold harmless PublicMe, its operator(s), employees, contractors, and partners from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from (a) your User Content, (b) your use of the Service, (c) your breach of these Terms, or (d) your violation of any law or third-party right.
14. Suspension & termination
- You may stop using the Service at any time and delete your account from the dashboard (when available) or by emailing support@publicme.app.
- We may suspend or terminate your access immediately if you breach these Terms, expose us to legal risk, or to comply with law.
- Sections that by their nature should survive termination (IP, disclaimers, liability, indemnity, governing law) will survive.
15. Governing law & dispute resolution
These Terms are governed by the laws of the Republic of India. Subject to the arbitration clause below, the competent courts in India will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
Arbitration. Any dispute will first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, it shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be in India and the proceedings shall be conducted in English.
16. Changes to these Terms
We may revise these Terms from time to time. The updated version takes effect when posted on this page. For material changes, we will give reasonable advance notice. Your continued use of the Service after changes means you accept them.
17. Miscellaneous
- Entire agreement. These Terms, with the Privacy Policy, are the entire agreement between you and PublicMe regarding the Service.
- Severability. If any provision is unenforceable, the remainder remains in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
- Notices. We may send notices via email to your registered address or by posting on the Service.

We endeavour to acknowledge grievances within 24 hours and resolve them within 15 days, as required by Indian law.
